NOTICE OF INTENT TO ISSUE REQUEST FOR QUALIFICATIONS AND PROPOSALS TO ENTER INTO A PUBLIC/PRIVATE PARTNERSHIP AGREEMENT FOR FULL SERVICE MULTIYEAR WATER STORAGE TANK ASSET REHABILITATION AND MAINTENANCE PROGRAM PURSUANT TO THE NEW JERSEY WATER SUPPLY PUBLIC-PRIVATE CONTRACTING ACT
Rockaway Township will receive proposals from qualified firms to contract for a Full-Service Water Storage Tank Asset Management and Maintenance Program. Respondents to the RFP shall include the complete maintenance and repair of all tanks identified as well as providing for the long-term full-service maintenance and management for each potable water storage tanks identified within this RFP.

All professionals interested in this Request for Proposals may obtain a copy of the RFP from Rockaway Township, 65 Mount Hope Road, Rockaway NJ, 07866 or on the township website at https://www.rockawaytownship.org/
Proposals shall be submitted in duplicate (2 Copies), sealed, and mailed or delivered to be received no later than the above time and date. The Township of Rockaway reserves the right to waive formalities in any proposal, and to reject any or all proposals in whole or in part with or without cause and/or to accept the proposal that in its sole judgment will be in the best interest of Township of Rockaway. The Township specifically reserves the right to reject any conditional proposal and will normally reject those which make it impossible to determine the intent of the proposal. This RFP is not a bid and the lowest cost proposal may not necessarily be chosen as the best solution for the long-term requirements of the Township.

If awarded a contract, your company/firm shall be required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et. seq. – Attachment C
This project is being awarded in a “fair and open” fashion, nothing further shall be required under the Pay-to-Play legislation (N.J.S.A. 19:44A-20.7)
The acceptance of a proposal by the Township is subject to and conditional upon the parties’ negotiation of a contract for the proposed services. The terms and conditions of any contract shall incorporate all requirements set forth in this RFP.
All construction contract disputes arising under this agreement shall be submitted to a process of resolution pursuant to alternative dispute resolution practice, specifically non-binding arbitration, pursuant to industry standards, prior to being submitted to a court for adjudication.
All costs payable to the mediator or arbitrator(s) shall be paid exclusively by the contractor. Owner shall bear none of the alternative dispute resolution costs. Any alternative dispute resolution shall be conducted at the Rockaway Township Municipal Building, 65 Mount Hope Road, Rockaway NJ 07866.
Nothing in this Article shall prevent the Owner from seeking injunctive or declaratory relief in court at any time. The alternative dispute resolution practices require by this Article shall not apply to disputes concerning the bid solicitation or award process, or to the formation of contracts or subcontracts to be entered into.
The joinder of parties to any dispute hereunder shall be governed by the provision of P.L. 1997, c.371.
