Competitive Contract Request for Proposals

Notice: Sealed proposals will be received by the Rockaway Township Division at 65 Mount Hope Road, Rockaway, NJ 07866, in accordance with NJSA 40A:11-4.1.

Submission Details

• Deadline: March 17, 2026, by 10:00 AM prevailing time.

• Responsibility: The vendor is responsible for ensuring delivery by the deadline. Late proposals will not be considered, regardless of the delivery method.

• Requirements: Submit one (1) sealed envelope marked "Original" and one (1) clearly marked "Copy."

Statutory Compliance & Evaluation

• Compliance: Vendors must comply with NJSA 10:5-31 et seq. and NJAC 17:27 et seq.

• Award Criteria: Contracts will be awarded based on price and other factors per NJSA 40A:11-4.1 et seq. and NJAC 5:34-4.1 et seq.

• Transparency: A summary evaluation report will be posted on the Township website at least 48 hours prior to the governing body award.

• Fair and Open Basis: This proposal is advertised under "Fair and Open" standards; no further requirements are needed under Pay-to-Play legislation (NJSA 19:44A-20.7).

Dispute Resolution

• Process: Disputes must first be submitted to non-binding arbitration (Alternative Dispute Resolution) per industry standards before court adjudication.

• Costs: All mediator/arbitrator costs are paid exclusively by the Contractor. The Owner bears no costs for ADR.

• Location: ADR shall be conducted at the Rockaway Township Municipal Building.

• Exceptions: The Owner may seek injunctive or declaratory relief in court at any time. ADR practices do not apply to disputes concerning the bid solicitation, award process, or contract formation.

• Joinder of Parties: Governed by P.L. 1997, c.371.
